Business EOIs submitted up until 24 February 2021 will continue to be assessed up until the below deadlines.

Business Program

The BSMQ business program closed at 12am (midnight AEST) on 24 February 2021. EOI’s submitted on Skillselect before this time will picked-up and considered for nomination.

Applications already invited and under consideration will continue to be assessed until the dates outlined below.

Subclass 132 visa applicants 
Subclass 132 applicants who have received an invitation to upload documents must submit all supporting documents by Tuesday 20 April 2021.

This is the last cut off date to upload documents, as the final nomination date for nomination to the Department of Home Affairs is Tuesday 27 April 2021.

If you are unable to submit your documents by Tuesday 20 April 2021, your application will be closed.

Your subclass 132 visa application must be lodged with the Department of Home Affairs within 60 days of nomination, and the latest, by 30 June 2021. From the 1 July 2021 the subclass 132 stream will cease.

Subclass 188 applicants

Subclass 188 applicants who have received an invitation to upload documents must submit all supporting documents in the two-week period provided by BSMQ. Failure to do so could see the invitation cancelled.

The last cut off date to upload documents to BSMQ for the subclass is Friday 18 June 2021.

The last date for nomination by BSMQ under the current 188 criteria is 30 June. However, you can submit your visa application to Home Affairs after this date, as long as it meets the normal 60 day requirement.

If you receive a nomination from 1 July 2021 by BSMQ you will be subject to the new subclass 188 criteria.

Business program 188 closed in Victoria

Closure of 2020-21 Business Innovation and Investment (Provisional) visa (subclass 188) nomination program

The Victorian Government’s Skilled and Business Migration program will not be accepting new nomination applications for the Subclass 188 visa after Monday 31 May 2021.

If you are seeking Victorian nomination for a Subclass 188 visa as part of the 2020-21 program, your application, including applications currently in draft, must be submitted by 5pm (AEST) Monday, 31 May 2021

This will ensure that the Victorian Government can assess all subclass 188 nomination applications submitted before the Department of Home Affairs makes changes to the Business Innovation and Investor Visa requirements on 1 July 2021.

Victoria’s standard processing timeframe for subclass 188 nomination applications is 4 calendar weeks for Subclass 188 Business Innovation and Investor streams and 1 calendar week for the Subclass 188 Significant Investor stream.

Visa 188A – Business Innovation stream

Visa 188A is for people with business skills and it lets you operate a new or existing business in Australia.

  • You must operate a new or existing business in Australia.
  • You must be nominated by an Australian State or Territory government agency.
  • Score 65 points above
  • proof of success business – Turn Over & Owner stake
  • Assets AUD800k above

Visa 188B – Investor stream

This provisional business visa stream requires you to invest at least AUD1.5 million in an Australian State or Territory and maintain business or investment activity in Australia

  • make an investment of AUD1.5 million in an Australian State or Territory
  • score at least 65 on the points test
  • have a net business, investment, and personal assets of at least AUD2.25 million

Visa 188C – Significant Investor stream

This provisional business visa is for people who invest at least AUD5 million in Australian investments that meet certain requirements and maintain investment activity in Australia.

  • be invited to apply for this visa
  • be nominated by a State or Territory government agency or Austrade to invest at least  AUD5 million that meets certain requirements and have a genuine intention to hold that investment for at least for 4 years
  • have a genuine intention to live in the State or Territory whose government agency nominates you

Visa 188D – Premium Investor stream

This provisional visa is for people who are nominated by Austrade and who invest at least AUD15 million in Australian investments and/or philanthropic contributions.
  • be nominated by Austrade
  • be invited to apply for this visa
  • invest at least  AUD15 million in Australian investments and/or philanthropic contributions that meet certain requirements
  • have a genuine intention to hold the investment for the whole period of the visa (except any part of the investment that is a philanthropic contribution)

Visa 188E – Entrepreneur stream

This provisional visa lets you carry out entrepreneurial activities in Australia.
  • undertake, or propose to undertake, a complying entrepreneur activity in Australia
  • have a funding agreement of at least AUD200,000 to carry out an entrepreneurial activity in Australia
  • show us a business plan for your entrepreneurial activity
  • have at least competent English

Business Innovation Extension stream – Visa 188 A&B

This visa lets holders of the Business Innovation and Investment (Provisional) visa188  in the Business Innovation stream extend their stay in Australia for 2 more years.

  • hold a Business Innovation and Investment (Provisional) visa (subclass 188) Innovation stream
  • have held the Business Innovation and Investment (Provisional) visa (subclass 188) Innovation stream for at least 3 years
  • not have held more than one Business Innovation and Investment (Provisional) visa (subclass 188) Innovation stream visa
  • be nominated by a State or Territory government agency.

Significant Investor Extension stream – Visa 188 C&D

This business visa lets holders of a Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor stream holders extend their stay in Australia for up to 4 more years.

  • hold a Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream and have held that visa for at least 3 years; or
  • hold a Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor Extension stream and not have held more than one of these visas
  • be nominated by a State or Territory government agency or Austrade

Business visa 188 is a temporary visa for 4 years 3 months, however, after 2 years according to visa streams will be eligible to apply for the Permanent Business Visa 888.

Visa 888 – Transaction of Visa 188

continue your investment activities started under your Business Innovation and Investment (Provisional) visa and stay in Australia permanently

You can apply for Visa 888 ( Permanent Residency Visa)  after at least 2 years you have your Visa 188 Granted

After the 2 years, you own and manage a business in Australia, you can apply for Visa 888

  • Continue to have an ownership interest in up to two main businesses in Australia
  • Had a direct and continuous management role in that business or businesses
  • Submitted Business Activity Statements to the Australian Taxation Office
  • An Australian Business Number for each of your main businesses
