A statutory declaration by a supporting witness in relation to a Partner or Prospective Marriage visa application

About the form 888

This form must be completed by a person who:

• knows the visa applicant and their partner or fiancé(e) and the history of their relationship;

• is at least 18 years of age; and

• is an Australian citizen or Australian permanent resident

Purpose of this form 888

When assessing a Partner visa 309/100, 820/801, or Prospective Marriage visa 300 application

the Department of Home Affairs (the Department) must consider the social aspects of the claimed relationship.

The Department will use the information provided in this form (your statements), among other things, to assess these aspects.

Declarations form 888 must be witnessed by a person

Prescribed persons include those who are a:

• Justice of the Peace;

• medical practitioner;

• legal practitioner;

• civil marriage celebrant or registered minister of religion;

• dentist;

• nurse;

• optometrist;

• pharmacist;

• physiotherapist;

• teacher employed on a permanent full-time or part-time basis at a school or tertiary education institution;

• bank officer with 5 or more continuous years of service;

• permanent employee of the Australian Postal Corporation with 5 or more continuous years of service;

• police officer; or

• public servant engaged on an ongoing basis with 5 or more years of continuous service.

If you are not an Australian citizen or permanent resident and you reside outside Australia, your statement cannot be considered a statutory declaration under Australian law, even if it is made using this form or the template provided by the Attorney-General’s Department.

However, under the policy, your statement should be witnessed or certified according to the legal practices of the country in which you make the statement.

Form 888 Example 1

Questions : how you know the applicant and the applicant’s partner or fiancé(e), and indicate how often you have been in contact with them

The occasion you meet each other and the regular bases for the contact

For example:

I have known both Emily, her husband Adam.
I first met Adam at work, the National Museum in November 2007 and we have been best friends ever since. I am lucky to have Adam in my life as he is like a brother to me and has been there for me at times when I needed help. He’s kind, generous and very genuine. 

Adam introduced me to Emily 4 years ago. I often speak to over the phone and we have formed a beautiful friendship. I’ve offered to be as the next of keen emergency contact as Adam has no family in Australia. So Emily has my contact details also in case something unexpected happens and can reach me.

Form 888 Example 2

Questions : State whether you believe the relationship of the applicant and his/her partner or fiancé(e) to be genuine and continuing, and give your reasons for your belief.

For example:

I believe Emily and Adam’s marriage is genuine. I have seen firsthand, the loneliness he feels not having any  relatives in Australia let alone his beloved wife. It’s been tough on him but he has kept his marriage strong by travelling to Italy every 6 months and spending several months with his wife and family.
The marriage has survived the long distance and  frustrations of not being able to live together for the last 4 years and it is still going strong. I believe this is a
testimony to how hard they work to keep and strengthen their relationship.

Form 888 Example 3

Questions : State any other matters you wish to add in support of the visa application

For example:

My only wish for Adam is that he is reunited with his wife and live the life he dreamed of in Australia. They are both hard working, healthy and productive members of society.
Their ability to survive the distance shows that they are the right fit for each other and are able to support each other in tough times. Sometimes, long distance can cause challenges such as sense of insecurity, growing apart,  frustration and helplessness but both Adam and Emily have been patient and hopeful that they’ll live together in Australia.
I have been working with Adam for many years and he’s a cherished colleague at work. Over the years, he has received several awards for his contributions, creative
thinking and supporting other colleagues.
